Objective and Purpose of the Assignment
The main objective of the task is to provide a product-service of good quality, ensure that draft
legislation conforms with good international practice and requirements.
Scope of Work
The expert will prepare drafts of law and legislation, relevant to Mongolia national legislation, with a
study work, and in team cooperation with the National legal expert.
Detailed Tasks and/or Expected Output
The individual must be willing to sign confidentiality agreements with the Government of Mongolia.
Responsibilities include:
(i) Review the existing and draft Mongolian laws, regulations and guidelines and academic literature
available in English, and produce conclusions;
(ii) Deliver study work on legislation and regulation of transparency in the extractive sector in other
countries;
(iii) Study and deliver findings/recommendations over a version of the Mineral resources sector
transparency law drafted by MMHI, provide recommendations for other drafts of the procedure, guidelines
and will review a completed version once again, provide recommendations.
(iv) Support for MMHI to make final drafting of making recommendations to ensure that the legislation is
consistent with other legislation and meets international legislative standards and best practice;
(v) Regularly undertake online meeting to meet with key stakeholders and to include findings into the
report;
(vi) Make amendments to the recommendations based on any feedback received from relevant stakeholders
and finalize the report; and
(vii) Prepare a final report which captures all of the elements delivered and sets out clear next steps
for the government in terms of their implementation.
The international expert shall work on a draft of the Mongolian EITI law and produce relevant
conclusions and recommendations. Then, draft and guidelines shall be developed in on-line format, he/she
shall communicate with the Client through the National legal expert.
Minimum Qualification Requirements
The international legal expert should have as a minimum, a degree in law, preferably a post-graduate
degree, such as a Master degree (or the equivalent), and at least 10 years of professional international
experience that demonstrates his/her extensive knowledge of mining sector legislation and regulation of
EITI globally. Direct experience in drafting or advising governments on similar or relevant law and
regulations is preferred. The expert must be fluent in English, both spoken and written, and must be
able to read and write English at a high academic level.
